it’s been a while since I did one of these, what with vacation and the outage.
#patentfun is a weekly article rounding up the litigation surrounding the Android OS… and is becoming less ‘fun’ than it is scary
So, since it’s been a while, I can’t even begin to try to get caught up, so I’ll just do some of the more recent scenarios and recap.
First off before I dive into it, I wanted to share this article from the Verge. All about the patent troll situation and who is it really benefiting? True enough, we’re beyond the trolls these days with near all-out war between Apple and Samsung, but the point remains, no really anybody is winning (except those involved in the legal system). I love the line he uses: ”Sunlight is the best disinfectant”
I’m hoping that somehow, some way, Apple gets the message that this is only ruining their reputation. People are starting to see that the company doesn’t want to litigate for someone else using their patents… they want to clear the battlefield. They don’t want to be rewarded with damages, they want injunctions. They don’t want competition.
Eerie… especially as you look how they came about as a way to be a ‘choice’ against the oppressive bigger companies.

Microsoft doesn’t mind taking some licensing… it’s a way to recognize their hard work, so long as the licensing fee isn’t too great. They’re not trying to crush competition.

I’ll have to get a friend of mine to explain to me standard essentials patents… there’s a lot of debate going on about what’s open source, versus standard essentials… some moral, mostly opinionated. What do you think?
I’m thinking that it mainly comes from a situation like we’ve seen with the (yet another) ANDROID KILLER PATENT and how it was recently awarded to Apple. Those kinds of patents are so generic in their usage that you would think that they invented a portable device. I’m hoping for a Palm corporate zombie to pop out of the ground and take Apple out… that’d be awesome. The kind of Sam Raimi ending (more Evil Dead than Spiderman) needed for this crazy scenario.

But she mentions just going to mediation… as we’ve seen, that doesn’t work.

the winner here is that Apple proves that their customers are dumb folk that can’t tell the difference between an iPad and a tablet of a different size… or they’d need to put a silver line around the outside to mark it. These must be the same folk that needed the hockey puck to be outlined in blue on the ice.

This is what I mean by “they don’t want damages, they want you out”. How is this fair and reasonable. $24/device for the design? Good freakin’ luck. If the iPad were a large painting, would you pay $2.5 BILLION for it?
I could see the small amounts for licensing (which they’re not interested in), but asking $24/device is ludicrous.

Design patents… really? I can’t believe you can get a patent on a ‘design’. You know, maybe in the 40′s and 50′s when they made those crazy looking cars with the fins and whatnot. But it’s not like it’s a logo? A rectangular box is not a design… it just so happens to be what an LCD is.
If Apple was really that concerned, maybe they should have handled it like Jack Daniel’s did:
